The fact that you mailed the obsolete bug-fileutils list implies that you
may be due for an upgrade. fileutils merged into coreutils, and the
latest stable version is now 6.9.

Sometimes it depends on your filesystem; for example, FAT is generally
handled as case-preserving but case-insensitive, which means that FOO and
foo name the same file, so the attempt to rename fails. You need to give
us more details about your OS and filesystem. Meanwhile, you can always
go through a temporary name: 'mv foo foo1; mv foo1 FOO'.
