Actually, I expected the same effect to occur until I read the
documentation of the key sequence (basically saying that it hogged the
minor mode map because Emacs 19 (!) had problems with overlay
keymaps), and then I had to actually try to make sure.  As to the
proposed patch you posted: I don't use flyspell-mode myself, just
reacted to a user of my package complaining about interference with
it, so I would not be really qualified to judge whether the patch does
something incompatible with its usual operation.  I hope some people
with more interest in flyspell-mode try it out and report their
experiences.  If none do in a reasonable amount of time, I'll try the
patch out myself, but since I don't use the mode, I would probably
not notice if some aspect of it got inoperative.
