i was using tar 1.23 and my backup was horribly breaking adding the use of
--listed-incremental, but i see that that particular issue has been resolved
in 1.26. i'm running 64 bit gentoo linux, fwiw.
my problem now is that other filesystems are being pulled into my archive.

in conclusion, using --listed-incremental seems to break using find and
--no-recursion, or am i missing something?
actually, looking into things more, my broken example is adding the
files but not directories nor their contents in /mnt/dvdtemp which is a
different filesystem (not everything in /mnt is a mount point, for
example /mnt/gentoo32, plus i want the structure of /mnt archived). in
addition to archiving contents of /mnt/dvdtemp instead of just that
directory it is also archiving everything else *twice*.
