Yes, it would do. Its a problem with Gentoo's capability.h header.

Having gone through this previously with another Gentoo user, this is
100% for certain a Gentoo problem. However, that was quite a while
ago and i dont remember the resolution - I have a vague memory it's
due to Gentoo, for some infathomable reason, having modified one of
the capability.h headers to define __KERNEL if you include
sys/capability.h.

No, its a preprocessing problem, one that appears to be specific to
either the sys/capability.h or linux/capability.h header file which
Gentoo installs.

You need libcap. But you must already have this installed to have hit 
this Gentoo header problem.
