Classpath code in Tomcat?

Poking around in Tomcat I was surprised to come across the following
in org/apache/tomcat/code/BufferedServletOutputStream.java:

   // This code was adapted (and cleaned up) from Aaron Renn's
   // BufferedOutputStream implementation from the Classpath project.

Did you know about this Aaron?  IANAL, but it seems like certain steps
would have had to been taken for this to be OK.
