[DMCA-Activists] HR5469 suspends noncommercial fees until 6/20/03 (Sect. 114/112)

The attached House of Representatives (H.R.) Bill 5469, as amended, now in 
the Senate, that should pass and become law shortly.  H.R. 5469 suspends 
noncommercial 114/112 fees (Artist/Label) for period October 28, 1998, to May 
31, 2003, until June 20, 2003.  It also suspends small commercial webcaster 
fees until December 15, 2002.

The purpose of the Bill is to give the entitled parties time to negotiate 
agreements with RIAA/SoundExchange and to receive and perhaps benefit from 
the decisions of the US Court of Appeals (DC Circuit) and (Third 
Circuit/Philadelphia).  

The National Association of Broadcasters (NAB) has an Appeal in the Third 
Circuit which is due for Oral Argument the first week in December.  

The Intercollegiate Broadcasting System (IBS) has an Appeal (Case # 02-1220) 
of the Librarian's Rates of June 20, 2002, and others in the US Court of 
Appeals (District of Columbia Circuit) which has not yet been scheduled for 
oral argument but will probably be heard in late winter/early spring.

IBS represents 800 Radio/Webcasting Members affiliated with education 
comprising over 95% of all such stations that affiliate nationally.  IBS has 
been continuously representing this group for over 62 years.  (See
