Throw an error, show a message to the user and refuse to start the
server. Why should it be different than trying to write a file and not
being able to?


Because if you choose a random port and just give up if you happen to get a busy one, you have a situation where emacs server works sometimes and doesn't sometimes randomly. That will lead to bug reports.
