    The same holds for any other GPL material distributed by the FSF
    but for which the FSF does not hold the copyright.  Nothing new
    here.

It is likely that the FSF checked the intent of the copyright holder.
Someone downloading from a package repository may not check as
thoroughly -- for one, they may be bored by this sort of thing.  I
agree, this is not new, but the danger persists.

    Refraining from doing something because of baseless FUD would be wrong.

I agree.  The trouble is that in the contemporary US, a fear of legal
suits is not baseless, especially if you are well known.  Fortunately,
I am not.
