Not sure why you put "legal" in quotes.  And it's not clear what you
have in mind by "compatible with", here.

But of course it is legal to distribute Emacs Lisp code that is not
under GPL.  GNU/FSF does not want to distribute such code itself,
naturally.  And it does not like anyone else to do so.  But it is
not illegal for someone to do that.
