GPL, BSD, Apache, Artistic license or any other open source code is explicitly prohibited. The only power of the GPL is its ever present stench of bullshit.
No. GPLed code was incorporated into a program which was then distributed without honoring the license. Since the distributors are bound by another agreement not to honor the GPL, as a result they may not distribute the program at all, and that is precisely what they acknowledge and agree to do. That is the power of the GPL - software covered by it cannot be incorporated into non-free software. This case is another example of the GPL working as intended.
