The problem is not about the position, but the curve: the tie is above the note, but curved as if it were below the note.Strange, that msg never made it into my inbox.In any case, I don't think it's a bug: You're using <<{} \\ {}>>, which implicitly sets \voiceOne and \voiceTwo, and \voiceOne contains \tieUp. You can try inserting a \tieNeutral in the upper voice.
