Follow-up Comment #1:

3.8.1 is a very ancient version of Octave and is no longer supported.  I can
run your script just fine in the current stable version of Octave (v4.0.1). 
It does prodce a warning about short-circuit operators, but just a
warning--not an error.

Upgrade to be able to run your script.
