It would be nice if you could get rid of the assert instead just moving it.

Also, I would like to see a rationale (if not as a comment, then along with the 
patch) for each XXX you removed.  Somebody put the comment there because he had 
doubts.  From looking at the patch, I can not decide if you didn't have those 
doubts because you had a better or worse understanding of the code than the 
person putting in those XXX :)
