The "#" is being seen by make as a comment. Try:
v:=$(shell grep NAME file1 | sed -e '/^\#/d;s/NAME:[ ]*//')
Alternatively you can use a variable to hide it:
hash := \#
v:=$(shell grep NAME file1 | sed -e '/^$(hash)/d;s/NAME:[ ]*//')
