Those files must remain in the repository in the Attic sub-directories
in order to ensure that you can reproduce the correct state of your
hierarchy at any point in the past. If you back up the repository as it
exists right now, and then restore that backup (at any time in the
future) those files should still be in the Attic sub-directory.
If they are appearing in the parent of the Attic directory, then I would
say that you are restoring the wrong backup (ie, you're restoring one
from the time when those files hadn't yet been deleted.)
If you are intentionaly restoring an older backup then it's not
surprising that the structure may not match the current repository
structure, since again it may be from when those file hadn't yet been
deleted.
