Bug or feature ?

First, thanks for this feature for all the devels who work on monit. Its really 
really great :)

My question is now, is this following a feature or a bug ? We have
configured few boxes run monit but there seems to be problem relating to
error reporting. When a certain program uses too much cpu, restart is
triggered but it seems that since we have alert configured also, kill
wont be accomplished and thus, also start fails.
