This subject comes up over and over again, and admittedly not everyone
agrees about the details.  However, it's safe to say that
D.J. Bernstein's opinion (which you referenced above) is not shared by
many competent copyright attorneys.  And if you read the text of the
original law at <http://www4.law.cornell.edu/uscode/17/117.html>, I
think you'll find it hard to justify your claim directly from that
text.

Also, I understand that the FSF legal counsel does not agree with you.
I suppose you could try to distribute your code anyway, wait for the
FSF to come after you, and then litigate the case; but this doesn't
sound like a productive use of anybody's time.
