The problem with all this is that it is fascinating (even if only to indicate 
how broken the system is in places) but so bleeding complex that 
understanding it becomes almost impossible (and partially dependent on 
opinion anyway).  

When combining copyright and trademark issues within the context of a license 
I am afraid I am even further form my competence than normally (not going to 
stop me having a go though...).  One interesting point to note is that I 
don't think you can add restrictions to the use of a trademark beyond those 
stipulated by law (In the same way I cannot contract my staff to work for 
less than the minimum wage or in dogy conditions that don't comply with HSE 
regs) any such clause in a contract or license would be unenforceable, and 
quite likely leave the rest of the license in place.  After all I can use the 
trademark without license under quite a few conditions, any license would 
have to be more lenient (or simply very clear) to be useful or enforceable.

I think I will leave it here, mainly because I am out of my depth, - so no 
offence if I don't respond to any reply.
