You are missing the point. It doesn't matter if
the GPL isn't a EULA. What matters is that it is
a license. If you own your copy, then you don't have
a license any more. Your first sale right depends
on the transaction being a sale, not a licensed use.
Once it is a sale, you have your copy and first sale
rights, but to get that you have to give up the
license.
