That would only be, if you're using an older version of lily.scm,
near the top it says:

   (define use-regex #t)

It was only some releases after I got no complaints from windows users
on this #t setting, that empty lines were allowed to lily.ps.

Please check which lily.scm is used, run ``lilypond -V foo.ly''.
