GNU Radio just jams in whatever sampling frequency you tell it.  
The OSS interface (or maybe some of the drivers below it) are pretty 
lame about reporting errors.  I've accidentally set the sampling frequency
to something like 1MHz, which didn't work, but didn't report any error
either.
